Privacy Policy

Localiza Rent a Car S/A, a legal entity governed by private law, located at Av. Bernardo de Vasconcelos, 377, Belo Horizonte/MG, inscribed in the register of corporate taxpayers (CNPJ) under number 16.670.085/0001-55 (“Localiza”), understands that the personal data and electronic records left by users (“Users”) when interacting with Localiza’s systems either in person or by telephone, or when using the websites, systems and pages of companies of the Localiza Group (“Pages”) are sensitive and relevant.

This Privacy Policy (“Policy”) describes in a simple, transparent and objective manner which data and information will be obtained from Users (“Data”), as well as how these Data are used and protected.

This Policy applies to all Pages and all products.

The principles of adequacy, purpose, free access, non-discrimination, necessity, prevention, data quality, security, transparency, consent and all other principles defined in the applicable legislation apply to this Policy.

1. User Acceptance and Amendments to the Policy

Access of the User to the Pages or to the physical or telephone service implies acceptance to this Policy.

Localiza reserves the right to change this Privacy Policy at any time, without the need for prior notice to the User. Users should re-read this Policy, in case of any amendment, as per the update date indicated at the end of this document.

2. Collected Data

Information that may be provided by Users includes, but is not limited to, (i) name; (ii) e-mail addresses; (iii) mailing address; (iv) telephone number; (v) banking and/or credit card information; (vi) information related to the National Driver’s License; (vii) social media account information; (viii) public profile information; (ix) personal documents provided; and (x) information about third parties such as relatives, main/additional drivers, members, legal representatives.

Localiza also obtains Data Automatically from Users through the use of cookies and other similar technologies in order to guarantee the best user experience, as well as conduct a statistical analysis of trends, manage web pages and media, track user behavior in the Localiza Portal environment, Managed Platforms and the like.

More specifically, the technologies that may be used by Localiza include, but are not limited to: (i) browser cookies; (ii) web beacons; (iii) tracking pixels; (iv) Internet Protocol (IP); (v) browser type; (vi) Internet Service Provider (ISP); (vii) reference/exit page; (viii) files accessed in the Localiza Portal and applications (HTML and graphics, for example); (ix) operating systems; (x) date/time stamp; and (xi) clickstream data to analyze trends in the Localiza Portal and Managed Platforms.

Users are guaranteed control over the use of cookies through Browser settings. Please note that the use of certain features and functions of the Pages may be limited when cookies are disabled.

3. Use and Treatment of Data

The Data will be used for the purpose for which they were collected, i.e. the establishment of a contractual relationship or the management, administration and improvement of the Pages, in order to better serve Users.

Under this Privacy Policy, Localiza is authorized to send marketing emails; disseminate advertising material through websites, applications, social media for business and messaging services; conduct surveys; and carry out any direct or indirect marketing actions for Users. The information that will be sent to Users may be of interest to them, such as offer of products and/or latest news regarding the Localiza Group’s core business.

In case Users do not wish to receive such information, they may request, at any time and at no cost, the cancellation of their registration and/or removal of the data stored in the Localiza environment.

4. Data Sharing

Localiza may share the Users’ information with the following recipients: (i) service providers for the Localiza Group, responsible for assisting in the provision of services and making Localiza products available; (ii) partners who have commercial relations with the Localiza Group for the development of activities, as well as for advertising purposes; and (iii) government, in case of legal or judicial obligation, for the protection of rights, compliance with duties, guarantee of security to clients, investigation of fraud and/or public questioning.

In the event of an international transfer of Data, the Localiza group undertakes to satisfy, in the transmission, one of the following conditions: (i) the recipient is in a country that ensures a level of data protection at least equivalent to the one provided by Brazilian law; (ii) the transfer is necessary for international judicial cooperation between public intelligence and investigative bodies, in accordance with the instruments of international law; (iii) the transfer is necessary to protect the life or physical safety of the User or third parties; (iv) the competent authority authorizes the transfer; and (v) the User has given his/her consent for the transfer, pursuant to this Privacy Policy.

5. Data Security

Localiza processes and stores User Data supplied or collected in a safe way through the adoption of practices and security measures of a technical, administrative and organizational nature, in order to ensure full protection, according to criteria defined by the best market standards and the applicable legislation.

Data security is intended to protect Data against accidental or unlawful destruction, loss, alteration, communication or any form of inappropriate or illicit treatment, as well as discriminatory information processing.

Our commitment to the proper handling of internal, customer and public information is based on the following principles:

Confidentiality: to ensure that only authorized persons have access to information on a need-to-know basis;
Availability: to ensure that authorized persons always have the information when they need it; and
Integrity: to ensure the accuracy and completeness of the information and its respective processing methods, as well as transparency in dealing with those involved.

Localiza undertakes to inform Users and the data protection authorities of any security incident that may lead to a risk or material harm to the User.

6. Data Transparency and User Rights

The Data will be retained as long as it is necessary for the fulfillment of the purpose for which it was collected, or in terms established by law or specific regulations.

Users may, at any time, (i) access the Data; (ii) rectify Incomplete, inaccurate or outdated data; (iii) request the anonymization, blocking or deletion of unnecessary, excessive or treated Data not in accordance with this Privacy Policy; (iv) request the transmission of Data to another product or service provider; (v) request the deletion of Data; and (vi) request the application of consumer protection rules in the protection of their Data, when applicable.

7. Websites and Third-Party Services

The Localiza Portal and Localiza’s Managed Platforms may contain links to third-party websites and applications. If Users access these websites and applications, third parties not linked to Localiza may collect, process and share information. Localiza is not responsible for the content or privacy practices of third parties.
